PINVAY PORTAL GENERAL TERMS AND CONDITIONS (FOR CUSTOMERS)
I. Introductory provisions and definitions
These General Terms and Conditions (the "Terms") govern the rights and obligations between the operator of the portal, Radek Aigel, Company ID: 74258575, registered office at Janského 554/3, 779 00 Olomouc (the "Intermediary" or "Pinvay"), and persons who purchase gift vouchers through the portal (the "Customer").
Portal: The internet platform operated at pinvay.cz (including mobile applications and widgets placed on business partners' websites).
Partner: A business entity (third party) that offers its gift vouchers on the Portal and is the exclusive provider of the goods or services to which the voucher is issued.
Voucher: A multi-purpose (open-loop) voucher issued by the Intermediary on behalf of the Partner, giving the Customer the right to redeem the nominal value of the Voucher with the relevant Partner.
Consumer: Any natural person who, outside the scope of their business activity or outside the independent exercise of their profession, enters into a contract with Pinvay or a Partner.
II. Role of Pinvay and nature of the Voucher
The Customer acknowledges that Pinvay is only an intermediary in transactions between the Customer and the Partner. The purchase contract (or contract for the provision of services) under which the Voucher is redeemed is concluded exclusively between the Customer and the Partner.
Vouchers sold on the Portal are multi-purpose vouchers (MPV) within the meaning of applicable tax regulations. VAT is not applied at the time of purchase. The Partner is obliged to issue a tax document with VAT only when the Customer redeems the Voucher for specific goods or services.
III. User account and guest checkout
Purchases on the Portal may be made through a registered user account or without prior registration (as a guest).
Note: Automatic shadow accounts and the loyalty wallet described in earlier drafts are not yet available. Until launched, this section does not apply.
IV. Order and conclusion of contract
Presentation of Vouchers on the Portal is for information only and does not constitute a binding offer by Pinvay.
The Customer selects the Voucher value and proceeds to checkout. Before submitting the order, the Customer may review and change the data entered.
The Customer submits the order by clicking a button labelled "Order with obligation to pay" or another unambiguous wording (e.g. "Pay").
The contract for intermediation and purchase of the Voucher is concluded when the Customer successfully pays the Voucher price. Pinvay will promptly confirm receipt of payment and deliver the Voucher to the Customer's e-mail address or wallet (Apple Wallet / Google Wallet).
V. Payment terms and delivery
Voucher prices are stated in Czech koruna (CZK) and are final. The Intermediary does not charge any additional handling fee to the Customer beyond the stated price.
Payment may be made online by card or via fast digital wallets (Apple Pay, Google Pay) through the secure Stripe payment gateway.
The Voucher is delivered exclusively electronically. The Intermediary does not charge delivery or packaging fees.
The Voucher contains a unique identification code (QR code and alphanumeric string), nominal value, validity period, and the Partner where it may be redeemed.
VI. Redemption conditions
The Customer must redeem the Voucher with the Partner within its validity period stated on the Voucher. After expiry, the Voucher lapses without compensation and the obligations of the Partner and Pinvay cease, unless mandatory law provides otherwise. Beyond its statutory obligations, Pinvay offers a goodwill period to refund an unredeemed Voucher after expiry (see Art. VII).
The Voucher serves as payment with the Partner. If the purchase value exceeds the nominal value, the Customer pays the difference directly to the Partner. If the value is lower, the Partner is not obliged to refund cash (the balance may remain on the Voucher or lapse according to the Partner's conditions).
VII. Consumer withdrawal (refunds)
A Customer who is a Consumer may withdraw from the Voucher purchase contract within 14 days of receipt without giving a reason.
Withdrawal may be made electronically by e-mail to aigelradek@gmail.com or via a form on the Portal.
The right of withdrawal cannot be exercised if the Voucher has been fully or partly redeemed with the Partner before the 14-day period expires.
Funds for a cancelled Voucher will be refunded no later than 14 days after approval of withdrawal, using the same payment method used for purchase. The Voucher is deactivated upon withdrawal.
Refund of an unredeemed Voucher after expiry: Beyond the statutory right of withdrawal, Pinvay offers the Customer the goodwill option to request a refund of the price paid for a Voucher that has not been redeemed and whose validity has already expired, within 6 months from the date on which the validity of the Voucher ends. The request may be submitted electronically to aigelradek@gmail.com or via the Portal. Upon approval, Pinvay refunds the full price paid using the same payment method, typically within 14 days; for a partially redeemed Voucher only the unredeemed part is refunded. After this period lapses, the right to a refund ceases and the Voucher lapses without compensation.
VIII. Liability for defects and complaints
Complaints regarding Voucher delivery: If the Voucher was not delivered, the code is invalid, or there are technical defects on the Portal, the Customer lodges a complaint directly with the Intermediary (Pinvay). The Intermediary will remedy defects without undue delay.
Complaints regarding the service/goods: As the Partner provides the final performance, all complaints regarding quality, scope, defects, or damage caused by the service or goods must be lodged directly with the Partner at their premises. Pinvay is not liable for the Partner's performance.
IX. Loyalty program "Pinvay Credits"
Note: The Pinvay Credits loyalty program is not yet active on the Portal. Until launch, the provisions of this section do not apply.
When launched, registered Customers may earn loyalty Credits (cashback). 1 Credit = CZK 1. Credits may be used as a discount on future purchases on the Pinvay Portal, subject to validity limits and a maximum offset of 20% of the order price. Credits cannot be exchanged for cash.
X. Out-of-court dispute resolution
In disputes between Pinvay and a Consumer that cannot be resolved amicably, the Consumer may use out-of-court dispute resolution. The competent body is the Czech Trade Inspection Authority (ČOI), Central Inspectorate – ADR Department, Štěpánská 44, 110 00 Prague 1 (adr.coi.cz). Consumers may also use the EU ODR platform at ec.europa.eu/consumers/odr.
XI. Final provisions
These Terms are valid and effective from 9 June 2026.
The Intermediary may amend these Terms to a reasonable extent. The new version will be published on the Portal. The version binding on the Customer is the one in force when the order is submitted.
Relationships not regulated by these Terms are governed by the laws of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code.
